End User License Agreement

This is the agreement shown by the Invictus Livery Manager installer. A copy is installed alongside the application as EULA.txt, together with THIRD_PARTY_NOTICES.txt and the licenses folder listing the open-source components the manager includes.

Revision 1, September 12, 2026.

This End User License Agreement (the "Agreement") is a legal contract between you (an individual or a single legal entity, "you") and Invictus Machine LLC, doing business as Invictus Cockpit Systems ("Invictus", "we", "us"), for the software identified above.

By clicking "I Agree", installing, or using the Software, you accept this Agreement. If you do not accept it, do not install or use the Software.

1. Definitions

"Software" means the Invictus Livery Manager application, its documentation, and any updates, upgrades, or components that Invictus provides for it, including the passthrough cockpit liveries and the simulator modifications it installs.

"Third-Party Components" means software, fonts, and other materials included with the Software that are owned by third parties and licensed under their own terms, as listed in the Third-Party Notices file distributed with the Software.

2. License Grant

Subject to this Agreement, Invictus grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on computers that you own or control, for the purpose of installing and managing liveries and cockpit modifications for flight simulation software.

Use of the Software is free of charge. Liveries that you obtain from other sources and install with the Software are not part of the Software and remain subject to the terms of their authors.

The Software may be installed on more than one computer in your household or organization. It is not licensed for resale, rental, or for providing services to third parties.

3. Restrictions

Except as expressly permitted by this Agreement, by applicable law that cannot be excluded by contract, or by the license of a Third-Party Component, you may not:

  • (a) copy the Software other than for backup purposes;
  • (b) sell, rent, lease, lend, sublicense, distribute, or otherwise transfer the Software to a third party;
  • (c) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software;
  • (d) modify, adapt, or create derivative works of the Software; or
  • (e) remove, obscure, or alter any proprietary notice in the Software. Nothing in this section limits the rights that the license of a Third-Party Component grants you for that component (see Section 4).

4. Open Source and Third-Party Components

The Software includes Third-Party Components, listed with their licenses in the Third-Party Notices file installed with the Software. Each Third-Party Component is licensed to you under its own license, not this Agreement. Where such a license grants you rights that this Agreement does not, that license governs for that component.

In particular, the Software uses the Qt framework through PySide6 under the GNU Lesser General Public License version 3. You may modify those libraries, replace them with your own versions in the Software's installation folder, and reverse engineer the Software to the extent needed to debug such modifications, as that license provides.

5. Simulator Software and Third-Party Services

The Software is designed to work with DCS World by Eagle Dynamics SA. Invictus is not affiliated with, endorsed by, or sponsored by Eagle Dynamics SA or the owners of any other software the Software interoperates with. Your use of such software is governed by its own terms.

The Software installs liveries into your simulator's user folders. When you use the VR Passthrough functions, the Software may also modify your simulator's settings file and, for the Lighting Engine, files inside the simulator's installation folder, as those functions describe. It keeps backups of the files it changes and offers a restore function. You are responsible for backing up your simulator configuration, and for complying with the rules of any multiplayer server you join while such modifications are in place.

The Software checks for updates and downloads liveries by contacting servers operated by GitHub, Inc. Those requests are subject to GitHub's terms and privacy policy.

6. Privacy

The Software does not require an account and does not collect or transmit personal information or usage data to Invictus. It contacts GitHub, Inc. to check for and download updates and liveries as described in Section 5. Diagnostic logs are stored only on your computer unless you choose to send them to Invictus.

7. Updates and Support

Invictus may provide updates to the Software. Updates may add, change, or remove features and may require you to apply the simulator modifications again to keep the Software working. Updates are subject to this Agreement unless they come with a replacement agreement, in which case your installation of the update constitutes acceptance of the replacement.

Support is provided as described at https://invictuscockpits.com. Invictus has no obligation to provide support, updates, or new versions.

8. Ownership

The Software is licensed, not sold. Invictus and its licensors own and retain all right, title, and interest in the Software, including all intellectual property rights. Any suggestions or feedback you provide about the Software may be used by Invictus without obligation to you.

Settings and backups that the Software generates from your own configuration belong to you.

9. Term and Termination

This Agreement is effective until terminated. It terminates automatically if you breach it. You may terminate it at any time by uninstalling the Software and destroying all copies. On termination you must stop using the Software. Sections 3, 4, 8, and 10 through 13 survive termination.

10. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVICTUS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. INVICTUS DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ANY PARTICULAR VERSION OF ANY SIMULATOR OR OPERATING SYSTEM.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL INVICTUS OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, LOSS OF USE, OR DAMAGE TO HARDWARE OR OTHER SOFTWARE, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

INVICTUS'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID INVICTUS FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY UNITED STATES DOLLARS (USD 50).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. In those jurisdictions, Invictus's liability is limited to the fullest extent permitted by law.

12. Governing Law and Disputes

This Agreement is governed by the laws of the State of Arizona, United States of America, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising out of or related to this Agreement will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction, except that either party may bring a claim in small claims court or seek injunctive relief in any court of competent jurisdiction.

13. General

This Agreement is the entire agreement between you and Invictus about the Software and supersedes any prior agreement on that subject. If any provision of this Agreement is held unenforceable, the rest remains in effect. Invictus's failure to enforce a provision is not a waiver of it. You may not assign this Agreement without Invictus's written consent; Invictus may assign it in connection with a merger, acquisition, or sale of assets. You agree to comply with all applicable export control and sanctions laws in your use of the Software.
